Περισσότεροι από 100 εμπειρογνώμονες – ειδικοί όλοι στο διεθνές δίκαιο ενώ οι περισσότεροι είναι κορυφαίοι ακαδημαϊκοί – προειδοποιούν ότι οι στρατιωτικές επιχειρήσεις των ΗΠΑ και του Ισραήλ κατά του Ιράν, που ξεκίνησαν στις 28 Φεβρουαρίου 2026, συνιστούν σοβαρή παραβίαση των κανονισμών του ΟΗΕ και εξηγούν γιατί ενδέχεται να συνιστούν εγκλήματα πολέμου.
Σε κοινή επιστολή τους, πανεπιστημιακοί, νομικοί και πρώην σύμβουλοι κυβερνήσεων εκφράζουν βαθιά ανησυχία τόσο για την ίδια την έναρξη του πολέμου όσο και για τον τρόπο διεξαγωγής του.
Στο επίκεντρο της κριτικής βρίσκεται η παραβίαση του Καταστατικού Χάρτη του ΟΗΕ, που απαγορεύει τη χρήση βίας μεταξύ κρατών εκτός εάν πρόκειται για αυτοάμυνα απέναντι σε άμεση απειλή ή κατόπιν έγκρισης του Συμβουλίου Ασφαλείας.
Σύμφωνα με τους ειδικούς, καμία από αυτές τις προϋποθέσεις δεν πληρούται. Το Ιράν δεν είχε εξαπολύσει επίθεση ούτε κατά των ΗΠΑ ούτε κατά του Ισραήλ, ενώ δεν υπήρξε και σχετική εξουσιοδότηση από το Συμβούλιο Ασφαλείας.
Ο Γενικός Γραμματέας του ΟΗΕ, Αντόνιο Γκουτέρες, έχει ήδη προειδοποιήσει ότι οι επιθέσεις υπονομεύουν τη διεθνή ειρήνη και ασφάλεια.
Πέρα όμως από την απόφαση των ΗΠΑ και του Ισραήλ για τον πόλεμο, οι ειδικοί εστιάζουν ιδιαίτερα στον τρόπο διεξαγωγής των επιχειρήσεων.
Αναφορές κάνουν λόγο για πλήγματα σε μη στρατιωτικούς στόχους, όπως σχολεία, νοσοκομεία και ενεργειακές υποδομές.
Χαρακτηριστικό είναι το περιστατικό στη Μινάμπ του Ιράν, όπου επίθεση σε δημοτικό σχολείο προκάλεσε τον θάνατο δεκάδων παιδιών και εκπαιδευτικών. Αν επιβεβαιωθεί ότι η επίθεση έγινε με αμέλεια ή με ανεπαρκή επαλήθευση στόχου, τότε – όπως σημειώνουν – μπορεί να χαρακτηριστεί ως έγκλημα πολέμου.
Η χρήση βίας κατά πολιτικών υποδομών, όπως μονάδες παραγωγής ενέργειας ή εγκαταστάσεις ύδρευσης, προκαλεί επίσης σοβαρές ανησυχίες.
Σύμφωνα με το διεθνές ανθρωπιστικό δίκαιο, τέτοιες εγκαταστάσεις προστατεύονται, καθώς είναι απαραίτητες για την επιβίωση των αμάχων.
Ακόμη και όταν έχουν διπλή χρήση, στρατιωτική και πολιτική, οι επιθέσεις πρέπει να τηρούν την αρχή της αναλογικότητας, αποφεύγοντας δυσανάλογες απώλειες σε αμάχους.

Ρητορική που ενθαρρύνει παραβιάσεις – διάλυση θεσμικών μηχανισμών
Στο κείμενο που υπογράφουν οι ειδικοί ιδιαίτερη έμφαση δίνεται και στη ρητορική πολιτικών ηγετών.
Δηλώσεις του προέδρου των ΗΠΑ, Ντόναλντ Τραμπ, ότι «δεν χρειάζεται το διεθνές δίκαιο» ή ότι στρατιωτικά πλήγματα μπορεί να επιχειρηθούν «για πλάκα», χαρακτηρίζονται από τους νομικούς ως επικίνδυνες και αποσταθεροποιητικές.
Αντίστοιχα, θυμίζουν ότι ο υπουργός Άμυνας Πιτ Χέγκσεθ έχει δηλώσει ότι δεν θα υπάρξει «έλεος» απέναντι στον εχθρό, φράση που στο διεθνές δίκαιο συνδέεται με την απαγορευμένη πρακτική της άρνησης παράδοσης, η οποία συνιστά επίσης έγκλημα πολέμου.
Οι εμπειρογνώμονες επισημαίνουν ότι τέτοιες δηλώσεις δεν είναι απλώς υπερβολές στο πλαίσιο της ρητορικής πολιτικών προσώπων, αλλά ενδέχεται να ενθαρρύνουν παραβιάσεις στο πεδίο των επιχειρήσεων. Η αποδυνάμωση των κανόνων εμπλοκής σε πόλεμο και η υποβάθμιση της σημασίας του διεθνούς δικαίου δημιουργούν ένα περιβάλλον όπου οι στρατιωτικές δυνάμεις λειτουργούν χωρίς επαρκείς περιορισμούς.
Παράλληλα, εκφράζεται ανησυχία για τη διάλυση θεσμικών μηχανισμών που είχαν ως στόχο τη μείωση των απωλειών αμάχων. Η απομάκρυνση στρατιωτικών νομικών συμβούλων και η κατάργηση ειδικών ομάδων προστασίας αμάχων στο Πεντάγωνο θεωρείται ότι αποδυναμώνει την εποπτεία και αυξάνει τον κίνδυνο παραβιάσεων.
Οι συνέπειες του πολέμου δεν περιορίζονται μόνο στο ανθρώπινο κόστος. Οι ειδικοί επισημαίνουν ότι οι επιθέσεις σε ενεργειακές υποδομές έχουν ήδη επιπτώσεις στην παγκόσμια οικονομία, αυξάνοντας τις τιμές ενέργειας και οδηγώντας αργά ή γρήγορα σε επισιτιστική κρίση. Παράλληλα, οι περιβαλλοντικές ζημιές από τις καταστροφές υποδομών ενδέχεται να έχουν μακροχρόνιες επιπτώσεις, όπως σημειώνουν.
Η ενημέρωση διώκεται
Ιδιαίτερη ανησυχία προκαλεί επίσης και η συστηματική φίμωση της ενημέρωσης. Στο Ιράν έχουν επιβληθεί περιορισμοί στο διαδίκτυο, ενώ δημοσιογράφοι και πολίτες διώκονται για τη δημοσίευση εικόνων από επιθέσεις.
Αντίστοιχα, περιορισμοί στην κάλυψη των επιχειρήσεων καταγράφονται και σε άλλες χώρες της περιοχής, αλλά και στις ΗΠΑ, όπου έχουν ασκηθεί πιέσεις στα μέσα ενημέρωσης.
Οι υπογράφοντες την επιστολή καλούν την αμερικανική κυβέρνηση να βεβαιώσει εκ νέου τη δέσμευσή της στο διεθνές δίκαιο και να λάβει μέτρα για την προστασία των αμάχων.
Παράλληλα, απευθύνουν έκκληση και προς άλλες χώρες να μην συνδράμουν σε ενδεχόμενες παραβιάσεις και να ασκήσουν επιρροή ώστε να τηρηθούν οι κανόνες του πολέμου.
Όπως υπογραμμίζουν, η κρίση αυτή δεν αφορά μόνο τη Μέση Ανατολή, αλλά το σύνολο της διεθνούς τάξης.
Αν οι ισχυρότεροι παίκτες αγνοούν το διεθνές δίκαιο, τότε υπονομεύεται ένα σύστημα ασφαλείας που δημιουργήθηκε μετά τον Β’ Παγκόσμιο Πόλεμο για την προστασία των αμάχων. Και αν αυτό το σύστημα καταρρεύσει, οι συνέπειες θα είναι τραγικές για όλο τον κόσμο.
